$130 Billion for K-12 Education Includes Special Education Dollars President Biden has signed the American Rescue Plan (ARP) into law which provides pandemic relief and stimulus funding to individual families, states, local and tribal governments, and school districts. For K-12 schools, the package includes $130 billion directed to states and districts. Thanks to COPAA members and special education allies, the ARP includes funding specifically targeted to support children, yo...uth, and young adults with disabilities under the Individuals with Disabilities Education Act (IDEA). IDEA funds provided to states are: $2.58 billion for Part B Sec. 611 (K-12), $200 million for Part B Sec. 619 (preschool), and, $250 million for Part C (infants and toddlers). This equates to a 20 percent increase to Fiscal Year (FY) 2021 appropriations for Part B Sec. 611 and a 50 percent increase to Part B 619 and Part C respectively. All requirements of the IDEA apply. In addition to IDEA funds, states and school districts will divvy up a whopping $122 billion with 90 percent of funds required to flow to school districts. States are required to use 5 percent of their funds to address the learning loss of students through evidence-based strategies including extended school day and year, as well as summer school and school districts must use 20 percent of their funding for the same. School districts have great flexibility in determining how to use the remaining 80 percent of funds through FY 2023 although new maintenance of equity requirements apply to assure children living in poverty [and their schools] are primary beneficiaries of federal funds. Children with disabilities and their families also benefited in the ARP through refundable tax credits to qualifying families, incentives to states to expand Medicaid eligibility, nutrition, and food assistance, as well as childcare subsidies.
