As many of you know, I recently purchased a Liberty Tax franchise. Please be assured that all Holliday Tax clients and their returns will continue to be handled personally by me. At this time, I am working out of both offices, so I won't be at my "usual" office as often. Our meeting location may change, but that's the only difference you'll see. Do I need a trust? One question I am frequently asked by our clients is "Do I need a trust? Or will a Will help me accomplish my estate planning goals?" A few notes of comparison: ... A Will doesn't go into effect until after you have passed away. It is a written document that records how you want your property to be distributed. Wills have to go through the court system as part of the public probate process. A Trust becomes effective immediately. When done properly, a trust avoids the probate process completely. Trusts give the grantor greater flexibility in how and when their assets are distributed, protect family privacy by avoiding the public probate process, and allow your heirs quicker access to your assets. Additionally, you can make your trust the beneficiary on financial accounts and real property (through the transfer on death deed) giving you a "single stop" for all your assets to pass through. Of course, each situation is unique and there is no "one size fits all" when it comes to estate planning. Especially for those of us with minor children.
