This past week Governor Stitt signed SB273 into law which will take effect on January 2022. We tracked this bill because it dealt with title 42 preparers. Below is a summary and the final language that became law. Summary: SB 273, author by Senator Marty Quinn and Rep. Nicole Miller requires any person preparing or persons charging a fee for the preparation or assistance in preparation of lien notices on personal property to register with the Oklahoma Tax Commission and submi...t a $50.00 annual registration fee. Any person found to prepare or assist in the preparation of a lien notice without registration shall be assessed a $100.00 penalty. The provisions of this measure do not apply to a lawful possessor or employee of a lawful possessor of the property for which such notices are issued. Final Language: SECTION 1. A person or persons charging a fee for the preparation or assistance in preparation of notices required by Chapter 2, of Title 42 of the Oklahoma Statutes, other than a person licensed under Title 5 of the Oklahoma Statutes, shall register with and submit a fifty-dollar annual fee to the Oklahoma Tax Commission; provided, however, such requirements shall not apply to a lawful possessor or employee of a lawful possessor of the property for which such notices are issued. All documentation related to notices prepared by a person required to register pursuant to this section shall include the name of the person. A penalty of One Hundred Dollars ($100.00) shall be imposed upon a person who prepares or assists in the preparation of notices in violation of the requirements of this section. The Oklahoma Tax Commission shall promulgate rules to effectuate the requirements of this section. SECTION 2. This act shall become effective January 1, 2022.

According to the Department of Energy’s web site the average price of Diesel Fuel in the Midwest Region is $ 3.197 per gallon for Monday, May 17th, 2021. You may add 11% Fuel Surcharge to each non-consent tow for Hookup, Mileage and Wait time, OR for HOURLY rates. Do not add the fuel surcharge to any other regulated fees such as Dollies, Rollback, Recovery Time, or Storage. This is not a mandatory fee. You are not required to charge a fuel surcharge unless you decide you want/need to charge the fee to help with the increasing cost of fuel. For the $112.50 Hourly Rate the 11% fee is $12.38 just in case that helps any.

We will have a meeting TONIGHT in Enid at Callahan’s Pub & Grill 220 N Independence, Enid, Ok. This is in downtown Enid so the parking is city street and I’m not too sure about parking lots around there. The meal will start around 6:30 PM and the meeting should start around 7:30 PM. The board has many things to touch base on and bring everyone up to speed. So hope to see you there! Again, Attorney Jon Franke may attend to discuss a project he wants to get started for the Slow Down-Move Over movement.
