Tribal Jurisdiction On March 11, 2021, the Oklahoma Court of Criminal Appeals ruled that Oklahoma Courts do not have jurisdiction to decide a criminal case where the defendant or the victim is a member of any federally recognized tribe when the crime was committed within any tribal boundary. This ruling applies to any case, past or present, whether you took a plea deal or a jury found you guilty even if the case is 50 years old! It doesn’t matter if you are incarcerated, on probation, or recently released. This ruling affects the vast majority of cases filed in our area.
