The Oklahoma Court of Criminal Appeals issued its much anticipated ruling in the case of Hogner v. State of Oklahoma. The trial court in the case had determined that the Defendant was Indian and that the alleged crime happened within "Indian Territory", specifically the Cherokee Nation. (Our communities: Adair, Sequoyah, and Cherokee Counties are "Indian Territory", within the Cherokee Nation). The Oklahoma appellate Court decided that the State of Oklahoma did NOT have juri...sdiction to prosecute the Defendant. I have filed several motions to dismiss in criminal cases, based upon a previous case, McGirt, for my Indian clients. We actually have a docket set in Adair County on Tuesday March 16 at 9:00 a.m. for the state cases to be dismissed based upon the Hogner ruling.
